This document sets out the conditions under which Nature Education Community Center, as a personal data manager, processes the personal data of Customers and other persons who use the Platform in any way, including visitors to https://www.neccesek.com/.

 

This Privacy Policy is supplementary to the Nature Education Community Center Platform Terms and Conditions of Use.

 

  1. The purpose of this policy

 

Through this Privacy Policy Nature Education Community Center aims to bring to your attention essential information about the gathering, processing and storage of personal data.

 

This Policy will outline how your data will be processed, the purposes, grounds and security procedures implemented, all under personal data privacy legislation.

  3. Processing of personal data - any operation or set of operations which is performed upon personal data or upon sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

  4. Personal data controller - the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data; where the purposes and means of processing are determined by Union or national law, the controller or the specific criteria for its designation may be laid down in Union or national law;

  5. The empowered person - the natural or legal person, public authority, agency or other body that processes personal data on behalf of the controller;

  6. Personal Data Processing Supervisor - the central autonomous public authority with general competence in the field of personal data protection, being the guarantee of respect for the fundamental rights to privacy and protection of personal data.

 

  1. Principles of personal data processing

 

Nature Education Community Center is determined to comply with the principles laid down in the legislation on the protection of personal data, which is why personal data are:

  1. Processed lawfully, fairly and transparently to the person concerned;

  2. Collected for specified, explicit and legitimate purposes and not further processed in a way incompatible with those purposes;

  3. Adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;

  4. Accurate, and where it's necessary, updated;

  5. Kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the data are processed;

  6. Processed in a way that ensures adequate security of personal data.

 

  1. Purposes of processing of personal data - general statement

 

Nature Education Community Center processes your personal data for the following purposes:

 

  • Providing services such as: guiding/training and organising groups of participants; organising creative and recreational activities and related activities; booking accommodation for organised activities; organising travel; hiring equipment; organising trainings and workshops; any other related activities organised by NATURE EDUCATION COMMUNITY CENTER;

  • Managing and administering the contractual relationship with our clients;

  • Meeting our legal obligations;

  • Analyzing and improving our services and communications to you, including (as we have a legitimate interest in continually improving our services) conducting customer surveys regarding customer satisfaction with NATURE EDUCATION COMMUNITY CENTER services;

  • The Client's name, surname and e-mail address, as well as photos and videos taken at our events, may be processed for marketing purposes, by Nature Education Community Center sending electronic messages regarding commercial communications, promotional information, articles of interest and the like. The processing of such Data for the stated purpose may only be carried out with the prior consent of the Client.

  1. Legal grounds

 

Data protection legislation allows the collection, processing and storage of data as long as there is a legal basis for doing so. Nature Education Community Center processes personal data in the following situations:

 

  1. Conclusion of a contract: personal data is necessary for Nature Education Community Center to take the necessary steps at your request to conclude a contract between Nature Education Community Center and you.

  2. Fulfillment of contractual obligations: the processing of personal data is necessary to fulfill our obligations arising from a contract concluded with employees, collaborators, partners, customers, etc.

  3. Provision of guiding/training services and organisation of groups of participants; organisation of creative and recreational activities and related activities; reservation of accommodation for organised activities; organisation of travel; rental of equipment; organisation of trainings and workshops; any other related activities

  4. Legal obligation: in some cases, we are obliged to process personal data in order to comply with a legal obligation (obligations relating to tax law, employment law, etc.).

  5. Legitimate interest: Nature Education Community Center may process personal data where the processing is necessary to achieve a legitimate interest of Nature Education Community Center such as undertaking and business development, as long as it does not override the interests of the data subjects.

  6. Consent: in some cases, Nature Education Community Center will request express and specific consent to process personal data. in these cases Nature Education Community Center will process personal data only after the express and prior consent of the data subjects.

 

  1. Categories of processed data

 

Nature Education Community Center processes the following personal data:

  1. Identifying information of individuals, including but not limited to: name, surname, address, telephone, e-mail, IP address.

  2. Financial data, including but not limited to: payment method, last 4 digits of bank card, card issuer.

  3. Photos and videos from Nature Education Community Center events. Nature Education Community Center will ask for your consent to use photos and videos from our events for marketing purposes, however it is possible that you may appear in the background of such material by mistake, even if you have not expressly given your consent.

  4. Also, by accessing the Platform, Nature Education Community Center's servers record certain information about your visit, such as your IP address, number of visits, browser type.

  5. Cookies: Nature Education Community Center uses small text files called cookies to streamline and improve the user experience. Some cookie files are required to run the site. Nature Education Community Center may also process cookie files, based on your express consent, such as:

 

  • Preference cookies: allow the website to remember information that changes the way the website operates, such as the language selected.

  • Statistical cookies: facilitate Nature Education Community Center's understanding of how users use the site by collecting data anonymously;

  • Marketing cookies: are used to track visitors to websites. The intention is to display ads that are relevant and interesting to each user and therefore more valuable to publishers and third-party advertisers.

Nature Education Community Center does not collect sensitive data within the meaning of data privacy legislation.

 

  1. Storage period of personal data

 

Nature Education Community Center stores data only for as long as the basis for processing the data exists.

 

With regard to the duration of storage of your data, Nature Education Community Center limits the duration of storage of personal data to the period necessary for the purposes and reasons mentioned above.

 

When assessing the storage period of personal data, Nature Education Community Center also takes into account their legal obligations in tax and accounting matters.

 

Once the legal or contractual obligation to store data ceases, Nature Education Community Center will delete the personal data, which will be recorded in the Nature Education Community Center's records.

 

Please note that in the event that Nature Education Community Center identifies another legal basis for the retention of personal data, the data will not be deleted and you will be informed of this. One such ground is the legitimate interest of Nature Education Community Center.

 

Personal data is not used to make an automated assessment of aspects of your personality or to make automated decisions about you.

 

  1. Rights of concerned persons

 

Subject to certain legal conditions, data subjects have the following rights in relation to the processing of personal data:

 

    1. The right to request a copy of the personal data we hold;

    2. The right to rectify any inaccurate or incomplete personal data;

    3. The right to object to or restrict our use of personal data;

    4. The right to erasure of personal data where the data subject has withdrawn consent, the processing is no longer necessary or the processing is unlawful;

    5. The right to data portability, which allows the data subject to receive a copy of the processed data we have received from him or her or to transmit it to another entity indicated by him or her;

    6. The right to withdraw consent for processing carried out on the basis of consent. Withdrawal of consent will not affect the lawfulness of processing on the basis of consent prior to withdrawal. In cases where the data subject withdraws his or her consent, Nature Education Community Center will no longer process the personal data and will take appropriate steps to erase the personal data. Nature Education Community Center may, however, process personal data if there is another legal basis for the processing.

Following the collection of personal data, if this is necessary for the proper functioning of the Platform or for other legitimate reasons, the Nature Education Community Center may transmit data subjects' data to the following recipients:

  3. Entities involved in the process of executing the services provided by the Nature Education Community Center, such as accommodation establishments, transport companies, etc;

  4. Other contributors providing services to Nature Education Community Center, including, but not limited to, accountants, attorneys, etc.

  5. Authorities, state bodies, rescue services, courts if there is any legal obligation of Nature Education Community Center in this regard.

 

  1. Technical and organisational actions

 

Nature Education Community Center is determined to implement technical and organisational steps to ensure that the processing of personal data complies with the conditions laid down in data protection legislation.

 

To this end, the Nature Education Community Center has implemented the following measures:

 

  1. Drawing up policies and regulations in accordance with the legislation on the processing of personal data and updating them from time to time,

  2. Instructing Nature Education Community Center employees and collaborators on the processing of personal data according to Nature Education Community Center policies and regulations.

  3. Conclusion of agreements with Nature Education Community Center's partners and authorised persons ensuring a legally required minimum level of personal data processing.

  4. Anonymisation of data where possible, so that the relevant data will not allow identification of the data subject.

  5. Limiting access to personal data strictly to employees who are involved in fulfilling our contractual obligations;

  6. Taking all possible measures to prevent unauthorised persons from accessing data processing systems;

This document contains the terms and conditions related to the services offered by Nature Education Community Center SRL, namely the conditions of use of the Nature Education Community Center Platform.

 

It is the responsibility of all clients to carefully read, understand and accept the terms set out in this document in order to participate in any event or activity of any kind organised by Nature Education Community Center SRL.

 

BY REQUESTING OUR SERVICES OR REGISTERING FOR ANY ACTIVITY ORGANIZED BY US YOU CONFIRM THAT YOU HAVE READ, UNDERSTAND AND ACCEPT THE NATURE EDUCATION COMMUNITY CENTER ADVENTURES TERMS AND CONDITIONS.

I. DEFINITIONS

 

1.1. Nature Education Community Center or the Provider - Nature Education Community Center SRL, with headquarters in Cluj-Napoca, str. Kovari, nr. 41, jud. Cluj, registered at the Trade Register under no. J12/4445/2018, CUI 39940231, with a bank account at Banca Transilvania, IBAN RO10BTRLRONCRT0468644501, e-mail: csilla.kosar@gmail.com, hereafter Nature Education Community Center.

 

1.2. Contract - means the consensual distance agreement between the Provider and the Client through the purchase of a voucher, by telephone and/or online without their simultaneous physical presence, regarding the sale of one or more of the Services by the Client placing an Order on the Platform and the acceptance of the Order by the Provider in compliance with the legal provisions and the terms and conditions for the online provision of Nature Education Community Center services.

 

1.3. Platform - means the website owned by Nature Education Community Center Adventures SRL with the domain https://www.neccesek.com/ and using Nature Education Community Center's logos, through which Nature Education Community Center presents the Services offered for provision, and Clients can choose the Services they wish to purchase or pay for in one of the payment methods accepted by the Provider, i.e. all social media pages belonging to Nature Education Community Center, such as Facebook page and Instagram etc.

 

1.4. Order - means a request placed by the Customer via the Platform by which the Customer expresses his/her commitment to purchase one or more Services under the terms set forth herein and/or agreed with Nature Education Community Center through a remote means of communication.

 

1.5. Services - any event and/or activity organized by NATURE EDUCATION COMMUNITY CENTER SRL, i.e. activities related or related to events.

1.6. Client – Client - any individual who is interested in the services offered by NATURE EDUCATION COMMUNITY CENTER SRL and who makes a reservation at NATURE EDUCATION COMMUNITY CENTER SRL events.

 

1.7. GDPR Policy - means the document that sets out the rules on the protection of personal data according to which NATURE EDUCATION COMMUNITY CENTER processes data subjects' data.

 

II. OBIECTIVE

 

2.1. NATURE EDUCATION COMMUNITY CENTER aims to organize nature education activities.

2.2. The services provided by NATURE EDUCATION COMMUNITY CENTER may include: guiding/training and organising groups of participants; organising sports and leisure activities and related activities; booking accommodation for organised activities; organising travel; hiring equipment; organising training and workshops; any other related activities.

 

III. PRICE AND PAYMENT METHOD

 

3.1. The price of participation in the events/activities organised by NATURE EDUCATION COMMUNITY CENTER will be determined by the Provider for each individual activity, depending on the services included for that activity. The price will be determined by the Provider according to the specific circumstances of the event, the estimated number of participants, duration, location and other circumstances of the event.

3.2. The price of participation in the activities organized by NATURE EDUCATION COMMUNITY CENTER will be posted by the Provider on the Provider's website/social media pages in the section related to each advertised activity.

3.3. At the time of registration, the Provider may request an advance payment from the Customer in the amount determined by the Provider. In this case, the validity of the reservation depends on the payment of the deposit.

3.4. At least 7 days before each event organised by the Provider, Participants are required to pay the participation fee in full. However, the Provider may set a different deadline for full payment, depending on the needs of each event, or may request full payment at the time of booking.

3.5. Payments shall be made by Participants by bank transfer to the account indicated by the Provider; payment shall be deemed to have been made when the Provider's account is credited.

 

IV. CONTRACT CONCLUSION

 

4.1. The contract between the Provider and the Client shall be deemed concluded if the following cumulative conditions are met:

- The Client has read, acknowledged and accepted all conditions relating to the event, including the NATURE EDUCATION COMMUNITY CENTER Terms and Conditions and the GDPR Policy;

- The client has registered for the event on the NATURE EDUCATION COMMUNITY CENTER Platform and has paid the deposit or full price, as appropriate;

- The provider has confirmed the registration by email/phone/SMS/Social media.

4.2. In case of non-compliance with the registration procedure, the Provider reserves the right to cancel the reservation and, if necessary, to refund the money paid by the Client.

4.3. This contract is made available to the Client in its entirety on the Platform and after booking the services it can be sent to the e-mail address provided by the Client.

4.4. The contract shall terminate automatically on completion of the actual provision of the service.

 

V. LIMITATION OF LIABILITY

 

5.1.Participation in activities organised by NATURE EDUCATION COMMUNITY CENTER involves certain risks and dangers. By accepting the NATURE EDUCATION COMMUNITY CENTER Terms and Conditions, Clients assume all dangers and risks inherent in such activities.

5.2. NATURE EDUCATION COMMUNITY CENTER is not responsible for accidents occurring during events / activities organised by NATURE EDUCATION COMMUNITY CENTER. The presence of the Provider's representatives does not mean that they assume responsibility for the Clients.

5.3. NATURE EDUCATION COMMUNITY CENTER may offer for its events transport, accommodation or other services provided by various economic operators on their responsibility.

5.4. NATURE EDUCATION COMMUNITY CENTER is exonerated from any liability regarding accidents, losses, damages of any kind that may result from transport/accommodation services or any other services offered by various economic operators, related to the events organized by NATURE EDUCATION COMMUNITY CENTER ADVENTURES SRL.

 

VI. THE CUSTOMER'S DECLARATION OF RESPONSIBILITY

 

6.1. By making a reservation, the Customer declares under his/her own responsibility the following:

 

- He/she wishes to participate in the chosen event organized by NATURE EDUCATION COMMUNITY CENTER SRL under the conditions announced by the Provider.

- He/she is aware that participation in the event requires physical effort and an adequate physical and mental condition, involves risks and dangers that the Client assumes, confirming that his health and physical condition allow him to participate in the event;

- He/she assumes the risks inherent in the events organized by NATURE EDUCATION COMMUNITY CENTER, caused even by the negligence of some people and assume full responsibility for participation in NATURE EDUCATION COMMUNITY CENTER events;

- He/she will follow the instructions and guidance of NATURE EDUCATION COMMUNITY CENTER representatives throughout the event and the event rules presented by the Provider's representatives;

- He/she will come to the event with the necessary and appropriate equipment for the event;

- He/she will use both his own equipment and equipment received or hired from the Provider or other economic operators in a proper manner, in accordance with the instructions for use, so as not to cause accidents, injuries or any kind of damage to other persons.

- He/she is aware that improper use of the equipment may endanger the health and/or life of the Client and others. Any injury, damage, injury or accident caused by the improper use of the equipment shall render the Customer liable;

- He/she agrees to and is aware of all safety rules and procedures and the conditions of the event as announced by NATURE EDUCATION COMMUNITY CENTER;

- During the event he/she will not be under the influence of alcohol, drugs or medication;

- He/she is fully liable for any damage caused to equipment and property of any kind used during the events;

- He/she will respect nature and the environment, leaving no rubbish or litter behind. Will also respect the flora and fauna of the places visited during the events.

- Declares that, to the extent that he/she or a person for whom he/she is responsible is injured during an event organized by NATURE EDUCATION COMMUNITY CENTER SRL, he/she releases the Provider and its representatives/members/employees from any liability for any material, moral or other damage. Should he/she suffer any kind of prejudice during an event, it shall not make any claim for damages, claim, complaint, referral and shall not initiate any legal or administrative proceedings in respect of or against NATURE EDUCATION COMMUNITY CENTER SRL / its employees / representatives for or in connection with any damages, compensation or claims or for sanctioning in any way NATURE EDUCATION COMMUNITY CENTER SRL / its employees / representatives;

- He/she has not been in contact with a person who has or is suspected of having a contagious disease and does not have or is not suspected of having a contagious disease;

- He/she is aware and accepts that NATURE EDUCATION COMMUNITY CENTER / its employees / representatives may cancel or postpone events or change the route and/or itinerary at any time due to weather conditions or for any other objective reason that could endanger the health and/or life of the Clients or make the event impossible to organise.

- He/she is 18 years of age, or to the extent that he/she is under 18 years of age, his/her parents have accepted the Terms and Conditions and are fully responsible for the minor;

- If accompanied by a minor, the Client assumes all responsibility for the minor, NATURE EDUCATION COMMUNITY CENTER SRL being exonerated from any liability towards the minor. Thus, the person accompanying a minor, declares on his/her own responsibility that he/she is the guardian/parent of the minor and accepts the NATURE EDUCATION COMMUNITY CENTER Terms and Conditions both for his/her own person and for the minor he/she is accompanying;

- He/she is aware and accepts that depending on the location and nature of the event, the conditions offered by the accommodation establishments may be different. Thus, he/she accepts that in some accommodation units there will be no toilet/drinking water inside the unit and that it may be necessary to sleep in the room with other people. (To the extent that you are not comfortable with this, you will notify the Provider in advance).

- He/she will respect the rules of the accommodation establishments where he/she will be accommodated.

 

 

6.2. Clients expressly accept all of the above and also agree and accept that if they do not comply with the stated on their own responsibility, the NATURE EDUCATION COMMUNITY CENTER Terms and Conditions, the rules of the event, do not have appropriate equipment, do not respect other clients or in any way prevent the event from taking place under normal conditions, they may be excluded from the event by NATURE EDUCATION COMMUNITY CENTER SRL representatives/employees, without refund of the price paid.

 

VII. CANCELLATION OF THE EVENTS BY THE PROVIDER

 

7.1. NATURE EDUCATION COMMUNITY CENTER reserves the right to cancel announced events.

7.2. If the event is cancelled for objective reasons such as, but not limited to, adverse weather conditions, legal impediments, war, state of alert/emergency or similar situations, pandemic, earthquake, fire, flood, avalanche, etc., the deposit and or price are not refundable. However, the Provider may decide to refund the deposit or the price or offer a voucher in the value of the amount paid for a NATURE EDUCATION COMMUNITY CENTER event, as long as no payments have been made from the amounts received and no expenses have been charged for the cancelled event.

7.3. To the extent that the Provider cancels the event for reasons related to the event, the Provider shall refund to the Participants the amounts received for that event.

7.4. Under no circumstances shall the Provider be liable for any expenses incurred by the Client in connection with the event other than the deposit or price paid.

 

VIII. CANCELLATION OF THE RESERVATION BY THE CUSTOMER

 

8.1. Participants can request cancellation of their reservation by phone or email at the following contact details: csilla.kosar@gmail.com, 0723004506.

8.2. If the Client cancels the booking at least 14 days before the date of the event, he/she may receive a voucher for a future event organised by the Provider, in the amount of the price / deposit paid, without any refund.

8.3. If the Client cancels the booking less than 14 days before the event, they are not entitled to a refund of the amounts paid to the Provider for the event, except in the cases provided for by law.

 

IX. ACCOMODATION

9.1. For some events, the price will include accommodation services provided by third parties with whom the Provider collaborates. In this case, the Provider has the right to choose the accommodation units according to location, price and level of comfort. Clients are aware and accept that accommodation conditions may vary, depending on the location of the event. Thus, some accommodation units may be mountain huts or different mountain guesthouses.

 

9.2. If the price does not include accommodation services, each Client is responsible for booking their accommodation in such a way as to be present at the start date and place of the event and to respect the itinerary of the event.

 

X. INTELLECTUAL PROPERTY RIGHTS

 

10.1. All intellectual property rights in connection with the Platform and/or services provided by NATURE EDUCATION COMMUNITY CENTER, including but not limited to copyrights and trademarks, shall remain the property of NATURE EDUCATION COMMUNITY CENTER SRL.

10.2. Customers/participants/visitors of the site are not entitled to copy, distribute, use, modify, alter or use the content of the Platform for any purpose other than that for which NATURE EDUCATION COMMUNITY CENTER has made the Platform available.

10.3. All photos and materials taken during the Marketing campaigns are the property of NATURE EDUCATION COMMUNITY CENTER and may not be used by Clients / Participants / site visitors for commercial purposes.

 

XI. COMPLAINTS

 

11.1. Users of the Platform may request the resolution of situations considered by them as deviations from the legal or contractual conditions of service provision.

11.2. NATURE EDUCATION COMMUNITY CENTER SRL takes every interest in resolving all complaints within a reasonable period of time, therefore, if Customers wish to complain about a certain aspect that is in disagreement with their expectations, they can directly address the NATURE EDUCATION COMMUNITY CENTER team at the following e-mail address: csilla.kosar@gmail.com, specifying the subject complained about and the details related to it, as well as the contact details.

11.3. The response deadline is a maximum of 15 working days from the date of receipt of the complaint.
